We, at ActivityGoGo CY Ltd (“Activitygogo”, “we”, “us”, “our”, ), put great efforts in making sure that your personal information is safe, used properly and in accordance with the Principles and Rights of the individual under GDPR.

This document explains our privacy policy for processing personal information regarding our platform. The process of your personal information is subject to the terms of this policy. By using our platform and submitting your personal data to us you are explicitly agreeing for us to collect your information. Please take the time to read our full policy. 

Nothing stated in this Privacy Policy can be construed as to derogate from the Activitygogo Terms of Service, and all stipulations herein will only be in addition to those of the Activitygogo Terms of Service. 

Activitygogo may change and update the terms of this Privacy Policy from time to time. If we decide to change our Privacy Policy materially, we will post prior notice of those changes on our Platform so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. In addition, Activitygogo will post the revised Privacy Policy here with an updated effective date. 

  1. What personal data we collect

1.1 While you visit our site, we’ll track:

  • Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
  • Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
  • Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

We’ll also use cookies to keep track of cart contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

  • Send you information about your account and order
  • Respond to your requests, including refunds and complaints
  • Process payments and prevent fraud
  • Set up your account for our store
  • Comply with any legal obligations we have, such as calculating taxes
  • Improve our store offerings
  • Send you marketing messages, if you choose to receive them

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for XXX years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

We will also store comments or reviews, if you choose to leave them. When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

1.2. If you register with the services through our Platform, we will ask you to provide personal information, including your name, address, phone number, email address, user name, and password. We may receive your payment transaction details, from the payment service provider to process transactions or to provide you with the Platform services. When you register or access the Platform with Facebook we might ask for additional information such as friend list, date of birth, etc. 
When you contact us, or when we contact you, we may receive and process any personal information that you provide us. By using the Platform, you agree to receive occasional promotional material and information regarding the Platform and Activities via email, phone calls, SMS, and post amongst others. 

1.3 When you access the Platform, our servers log certain ‘traffic/session’ information from your device, such as your user agent and the Internet Protocol (IP) address. 
When you use the Platform, we collect information about your Platform activity, for example your log-in and log-out time, the duration of Platform sessions, the content uploaded and downloaded, viewed web-pages or specific content on web-pages, activity measures and geo-location. 

1.4 The content you upload to the Platform may include Personal Information. The uploaded content may be accessible to others. 
Please use caution when uploading the content, and avoid any involuntary disclosure of your personal information or disclosure of others’ personal information without their consent. If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.
The Platform may provide registered users and visitors various opportunities to submit or post Contributed Content, through or in connection with the Platform from time to time.

2.1 We use and store the personal information we collect and receive to provide the Platform services to you and to other users, to enable the Platform’s tools and features, to study and analyze the functionality of the Platform and users’ activities, to provide support, to measure Platform activity for pricing purposes, to maintain the Platform, to make it better and to continue developing the Platform. 
We may use your contact details or provide them to the relevant Activity Provider to contact you when necessary, to send you reminders, customer feedback request and to provide you information and notices about the Platform. We may include commercial and marketing information. We may provide messages and updates related to the Platform.
We obey the law and expect you to do the same. If necessary, we may use your identifiable information to enforce our terms, policies and legal agreements, to comply with court orders and warrants, and assist law enforcement agencies, to collect debts, prevent fraud, misappropriation, infringements, identity thefts and any other misuse of the Platform, and to take any action in any legal dispute and proceeding. 
We commit to process personal information solely for the purposes described in this policy. For any other use of your Personal Information we will obtain your prior consent. 

  1. Who we share your data with

3.1 We do not sell, rent, or lease your personally identifiable information. We may share your identifiable information with service providers and other third parties, if necessary, to fulfill the purposes for collecting the information, provided that any such third party will commit to protect your privacy as required under the applicable law and this policy. 
For example, we will share your payment transaction details with the payment services providers, to process and verify your payments. We may use a service provider to manage our email messages transmission. 

We may share your personally identifiable information for marketing purposes. For example, we may share your active listings on our social media accounts to promote them.
We may also share personally identifiable information with companies or organizations connected, or affiliated with us, such as subsidiaries, sister-companies and parent companies, with the express provision that their use of such information must comply with this policy. 
We may report any uploaded content and share user identifiable information, if we believe, in our sole discretion that such content is illegal or abusive or may violate any third-party rights. 
Additionally, a merger, acquisition or any other structural change may require us to transfer your personal information to another entity, provided that the receiving entity will comply with this policy. 

3.2 For monitoring and customer service purposes, the redeemable information of a gift card, which includes information on past redemptions such as the product name, redeemable amount, the provider who redeemed it and the date and time of the redemption, is made available to all the participating providers you choose to share your voucher code with and to the purchaser and/or receiver of a gift card.

3.3 Who on our team has access

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and
  • Customer information like your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.

We may use standard analytics tools. The privacy practices of these tools are subject to their own privacy policies and they may use their own cookies to provide their service (for further information about cookies, please see the ‘Cookies’ section in this policy).

We use anonymous, statistical or aggregated information and may share it with our partners for legitimate business purposes. It has no effect on your privacy, because there is no reasonable way to extract data from the aggregated information that can be associated with you. We will only share your identifiable information subject to the terms of this policy, or subject to your prior consent.

5.1 At any time, you may unsubscribe from our mailing lists or newsletters, by sending us an opt-out request to: [email protected] or use the unsubscribe options in all marketing materials sent to you.

We request and collect minimal personal details that we need for the purposes described in this policy. At any time, you may opt to terminate your use of the Platform. Thereafter, we will stop collecting any personal information from you. However, we may store and continue using or making available certain personal information that is related to you. For further information, please read the Data Retention section in this policy. 
If you wish to receive or review a copy of your Personal Information which is held by us, you have the right to request and we will send it to you. We may charge you a fee – which will not exceed the maximum amount permitted by law in the U.K. – in relation to fulfilling such a request for access to Personal Information. 

5.2 At any time, you may contact us at: [email protected] and request to access the identifiable information that we keep about you and to verify the accuracy of the data. 
We may need to ask you to provide us certain credentials to make sure that you are who you claim you are. If you find that the information on your account is not accurate, complete or updated, then please provide us the necessary information to correct it.

We may redact from the data which we will make available to you, any personal information related to others. 

  1. Data Retention

We retain different types of information for different periods, depending on the purposes for processing the information, our legitimate business purposes as well as pursuant to legal requirements under the applicable law. 
For example, we may need to keep the information about the payment transactions that you made for several years due to tax related requirements, for accounts settling, record keeping, archiving, and legal issues. 
We may keep aggregated non-identifiable information without limitation, and to the extent reasonable we will delete or de-identify potentially identifiable information, when we no longer need to process the information. 
In any case, as long as you use the Platform, we will keep information about you, unless we are required by law to delete it or if we decide to remove it at our discretion. 

  1. Transfer of Data Outside Your Territory

Activitygogo is a web-based Platform. We may store and process information in various sites throughout the globe, including in sites operated and maintained by cloud based service providers on sites in the United States. If you are a resident in a jurisdiction where transfer of your personal information to another jurisdiction requires your consent, then you provide us your express and unambiguous consent to such transfer. 

  1. Contributed Content and Public Content

You understand and agree that Contributed Content, as well as information regarding user’s profile picture, user name, and activity of registered users may be published on the Platform. Any person (whether or not a user of Activitygogo’d services) may read your Contributed Content and a registered user may also watch your Contributed Content without your knowledge. 
Please use caution when uploading the content, and avoid any involuntary disclosure of your personal information or disclosure of others’ personal information without their consent. 

  1. Cookies

9.1 Cookies are packets of information sent to your web browser and then sent back by the browser each time it accesses the server that sent the cookie. 
Some cookies are removed when you close your browser session. These are the “Session Cookies”. Some last for longer periods and called “Persistent Cookies”. 
We may use both types. We use Persistent Cookies to remember your log-in details and make it easier for you to log-in the next time you access the Data. We may use this type of cookies and Session Cookies for additional purposes, to facilitate the use of the data’s features and tools. 
Every browser allows you to manage your cookies preferences. Please bear in mind that disabling cookies may complicate or even prevent you from using some areas of our Platform or certain features of our Platform. 

9.2 Embedded content from other websites:

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

We and our hosting services implement systems, applications, and procedures to secure your personal information, to minimize the risks of theft, damage, loss of information, or unauthorized access or use of information. 
These measures provide sound industry standard security. However, although we make efforts to protect your privacy, we cannot guarantee that the Platform will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse.
